 2 Nepali in detention facility after one free night – please help

Greetings:

 

I just came to know that one of my far relative is in immigration detention facility since 3 days. He called me from the detention center and asked for the help. He is from poor family who lives in remote Nepal and can not afford the lawyer’s fee. I can manage couple hundred dollars but I’m sure it will cost more than that which is also beyond my limit. Personally, I never met him in my life since he lived in remote area of Nepal.

 

Here is his story (short version):

~ Came to El Salvador with the help of Agent who promised to help to cross US border.

~ Walked couple weeks through the dense forests and mountains and arrived in Mexico with the help of different agents. During this period, he met 2 other Nepali also.

~ From Mexico, he was able to cross the US border along with other bunch of people. Then they spent one “free” night in one place (don’t know exactly where) and next day early morning there were caught by ICE and sent to different detention facility.

~ Currently he is in Arlington detention facility along with one other Nepali (don’t know his name).

 

Could someone please suggest me what should I do and how should I help them? Here are few questions that I’m trying to find the answers:

# Is it possible to get them out from facility/jail as refugee showing political cause in Nepal.

# How long ICE will put them on detention facility before deporting? I heard it can be couple months too.

# Is it possible to speed the deportation process by paying some money for air airfare.

# How much roughly the lawyer will charge to take this case?

# Any help they can get from Nepalese Embassy, association, community …

They will provide with a list of ProBono lawyers, they charge minimal fee or no fee. PAHILO PATAK PAKDEKO HO VANE CHAI BOND HUNA SAKCHA ANI KASARI PAKDEKO TYO PANI DEPEND GARCHA. ABA POLITICAL ASYLUM FILE GARERA JUDGE KO AGADI JANE KOSIS GARNA LAGAUNU PARCHA ANI BOND HEARING HUNCHA.

AND YOU CAN'T SPEED UP THE DEPORATATION PROCESS BY PAYING FOR THE FLIGHT. IT ALL DEPENDS ON THE INDIVIDUAL'S CASE OFFICER. BUT BY LAW IF YOU SIGN YOUR DEPORTATION, THEY ARE SUPPOSED TO SEND U BACK WITHING 90 DAYS.

LAWYERS CHARGE U SOMEWHERE FROM 2000 8000 FOR A CASE.

The following links are for Pro Bono (free) or low cost legal  service providers in  Texas.

The Probar project in Texas is run by the American Bar Association so it's legitimate, but, there might be rules governing whether or not they can help these Nepalese. http://www.abanet.org/publicserv/immigration/probar.shtml

http://www.usdoj.gov/eoir/probono/freelglchtTX.htm (this is a copy of the list that the DOJ officals should hand your cousin so he can call...it would be very helpful to him if you made these calls becuase these folks are difficult to contact on the first try)

http://www.aila.org/content/default.aspx?docid=20394: AILA is the American Immigration Lawyers Bar Association and they do wonderful work and have some very educated/dedicated lawyers as members so you may have some luck through them as well.

With respect to the process; I don't think the IJ will grant bond in this case even if the judge does state a amount it will be steep (i.e anywhere between $10,000 - $25,000: you post 10% of the bond amount to be released from detention)

Political Asylum is a choice, but it's a tough one as they would need to prove that they have either faced persecution in the past or are afraid to return to Nepal for fear of future persecution...it's a complicated process so make sure you speak with an attorney before they sign any papers.

Thank you for taking your time to reply this thread with valuable suggestions. Like you guys suggested I'll try to contact pro bono representative/lawyer in that area. I'll keep you guys posted with new development.

Due to lack of proper information, rigid in decision making, running in hear say ( that's the life in Nepal), magical place  all problems are solved as got inside the usa boarder.

This story is not like someone hurt and needed medical emergency. Though I see this gentle man is dedicated and focused, Once he get out of detentain center , he will be doing better. Assylum is the only way he can get out. Must prolong the assylum so he can make money and go home in case denied.

While I discused it to another fellow, he told me this story.

एक जना युबक सब-inspctor को जागिरमा तालिम लिदै गरेको समयमा , शनिबारको बिदामा घर आएको बेला भाउजु सँग , तालिम लिन नसक्ने भए छोडि दिन्छु भनेर सुनाएछन, भाउजुले दाई लाई सुनाए पछी , दाई को जवाफ मा , जागिर खान जानु अगाडि सोधेको थियो र अब छोडने कुरामा सोध्नु पर्‍यो?

तेत्रो खर्च को रकमले सानो तिनो ब्यापार नै गर्न सक्थेनी ? बिदेसमा गए पछी चर्पी पुछन हुन्छ तर नेपालमा भने खुद्रा ब्यबसयी हुनलाई स्यानो हुईन्छ । अबस्य पनि ७-८ लाख भन्दा बदी खर्छ गरे होलान ।

I have personally met people who  crossed border from Mexico. I met them while I was in Texas.

i have heard they spend 10+ lakhs to get to US illegally

i dont get this...........y risk ur life, money to come US.......

10+lakh is a big sum of money

dont know what they think while coming
