i guys, i
have been in US for last 4 years and have been working here either in
check or cash. Until last year i had student work authorization and was
not worried about my status but this year the USCIS did not approve my
employment authorization and I am still in my job and paying tax. Do
you guys think this is gonna be a problem for me? i just heard a news
about a nepali student who was deported from port of entry in US just
because he had a history of paying tax and working illegaly. i am
planning to go to nepal this summer and i am afraid of not being able
get in US after returning back. please suggest me , greatly
appreciated.

Under table jobs are not reported to IRS and need not to be worry about. Once you got the work authorization and started job legally , has to file tax. Logically, you have worked with authorization and assuming you still have it. If the case is like I assumed then you do not need to be worry about. I am guessing you did not file for those years worked for cash.

You need to FILE TAX RETURN no matter what. It does not matter if you work or not OR you work in cash or check.

As kalovale said, you must file tax if you have reported income. By law you have to pay tax even earn illegally. No one files tax for cash or under table job.
Regarding the immigration, better have lawyer's opinion rather than our speculations.

To the best of my knowledge, the problem arises when u leave US and come back.At the port of entry,they will check your social security number and pull details to make sure you weren't involved in any kinds of illegal activities and if they notice the income received in check(for F-1)it might be a trouble.Don't be in dark that they will let u go if u had paid the taxes.That doesnot make sense, even though u r not allowed to work ,paying taxes doen't justifies the violation of law.U are still an international student on F-1 visa no matter whether u paid taxes or not.Paying taxes doenot mean u have became a resident. What I have heard in some cases is some Nepali students were fined for working illegally when they try to reenter US and DHS didn't bother them much except the fine.It might not be the same for all.Guys we need to consider the worst consequences that might occur if we r found.

I am F1 student (graduate) and recently I have accepted fulltime postion on Campus ( 40hrs/week). It is regular fulltime job and I was selected through Interview process.
My ISA officer suggested that I can work 40 hrs on campus ( We are allowed 20 hr on Campus as student + 20 hr on CPT = Total 40 hr, which makes sense) but still sometimes I feel I might be doing wrong. However my work is very closely related with the thesis I am working on and my academic advisor his given me all his support.
My first question is: * As F1 student can I accept full time postion? * Can we work 40hrs on campus with 20 hrs CPT for additional 20hrs ?
I am planning to go Nepal this summer. Will they question me/create problem at port of entry?
It would be great if you guys can share your ideas or is there any way I can get consulting from lawyer ?

hya mula bro haru, hawatal ma tarsine? One of my friends in college went to Ocean City twice...he worked there without work permit..and guess what? He went to Nepal last winter..and this winter too. What's this bullshit about Port of Entry? Don't believe in this sort of nonsense yaar. And who says that you can only work for upto 20 hours a week? The main reason why the U.S. govt doesn't want you working a lot of hours is, they think that it's gonna hamper your studies..so it's a guideline, not exactly a restriction or rule enforced by law. You guys need not worry yaar...
Also, don't listen to hypocrites. I've worked w/ and without work permits and filed taxes for 3 years in succession. What's more, I've filed taxes on turbotax.com. Mula I've never had any troubles...neither have any of my friends had any troubles. yo ke tension liyiraheko. US govt is worried about mehicanos, not Nepalese! Chill out and do the right thing! Mr Fire, No, You cannot work 40 hrs on F1 visa during school year. You can either choose to work 20 hrs for your co-op or 20 hours on campus. You cannot combine the two at all. Thatz the law. However, I dont think you are going to have any significant problem even if you did. The school always warns you if they found it. So be careful and do wtever it takes to finish your studies.

Guys, the bottom line is, if you do not get caught, you’re not guilty. That does not mean it is ok to work without work permit, SSN stating ‘Not Valid to Work’ or 40 hrs during the regular school semester. But since we do not have too many choices, we are usually forced to take that risk. Based on my personal experience and observations, I have not seen any Nepalese student being deported or chased by the law for working without authorization. However, I have read several cases where this may cause an issue during the green card process. USCIS sometimes ask for the proof of work authorization during the time you worked as a student. I guess, just make your own judgment while dealing with these kind of scenarios. Do what you gotta do, but don’t let this issue to make an impact on your future. Good luck!!

fulltime CPT ma if u work for less than 1 year, fine; but if it is more than or equal to 1 year, OPT ma problem huncha. That's what I know.

Just curious, the employer should have known that your work authorization is expired, did the employer applied for H1 status ? or you just request for extension of work permit, which is impossible and you knew it. Usually, once we get a job then we try to get H1 visa. Questios is which visa status you are in Now??? You must concentrate on being on legal status rather than IRS and going home.

Thanks to everyone for valuable inputs.
marconi: I am on 20hr CPT (Part time) and I guess there is no restiction on how long you can work on part time CPT.
garibbakochhora: I had doubts after I applied, so I asked the manager to drop my application (after interview). But by that time they had already selected me. So this guy (manager) went up to HR, ISA officer and my professor and talked about the issue. Finally it was ISA officer who suggest that I can work by combining 20hrs + 20hrs and everyone agreed to it. Here we need to re-issue CPT every semester. I already did twice and ISA officer was happy to know that I am doing good over there. I even asked ISA officer that will it be problem at port of entry and he said "just tell them, I had to work more than 20hrs on campus so part time cpt was issued". Now the time to go home is getting closer and it is really making me worry.
Guys do you have any idea Where can I get assistance from a lawyer who is good at all these stuffs.

Hello Mr Fire, You know wt, i may be completely wrong. I did my co-op for a year, my employer would not let me work even 21 hours. I was instructed by school official to quit my on campus job or not to exceed more than 20 hours combining co-op and on campus shit. You know what else, they may be wrong too. Why dont you ask ISA to issue you a letter stating that you were authorized to work 40 hours, you can use that if anything shitty happens while coming back.I really dont think you will have any problem coming back in either case, unless you have a pending criminal case ni american courts, obviously u dont. Aight brother, itz your call now. Once again, JUST BE CAREFULL. You have invested too much in this country to make any unnecessary decisions.

Guys,
Keep one thing in mind.There are certain rules regarding the eligibilty to work for F-1 students.They haven't checked or enquired if sb worked offcampus or more than allocated hours, but this doesn't mean they will never do.I just want to say be cautious and act wisely.Don't go after sb who says my fren did this ,did that and he never got caught.Remember they might enquire in ur case and u don't want to be a victim.U guys know how they act?Some time a student with good academic,financial condition is rejected while a student who barely passes exam and have false documents gets visa.Can't predict anything!If some happens ur dreams will be shattered,ur life will take a different turn,the expectations held by ur parents will go invain. Before doing all those things , think twice wat happens if it comes to u?Guys,I don't want to discourage any body.I am just like u.There is no difference between u and me.I can't imagine that happening to me and so do u.So,watever u do ,do safely.There are lot of possible ways and it might take one more year but still u make make it.
Everything is going alrite today doesnot mean it will be forever.Time is dynamic...........take that in mind.

m currently studying in texas in a comunity college. I ve quite a big problem because yesterday my passport got stolen from my friends' car. outside our apartment
somebody broke in my friends car and stole my bag in which i had some
money and passport. i was planning to visit nepal this summer and i ve
already booked my ticket. i am applying for my new passport tomorrow
but im not sure if my visa and i 94 will be re issued from here.
hopefully i ll get my new passport next week but i need a visa and i
94 to travel to nepal and come back. so, please help me with my problem
and tell me if the immigration issues f1 visa. and i 94. if not how can
i get visa from here ASAP and from where and what documents do i
need!!. if i go back to nepal may be ill be rejected for the visa cuz i
transferred from my first college to a community college.
i also heard that they issue passport from mexico or canada . plz tell
me wat are my chances to get visa from here. i ve never been out of
status and i just ve been here for 2 years and my visa was for 5 yrs.
so plz help me.

For me , i am here since 2000 and from last four years i am filling my taxes, and receving some handsome money from my tax returns. I am a F- 1 student. Within 5 year period I went 3 times outside United States, 2 times NEPAL and last time to Mexcio. I never had a issue at port, neither they asked me or inquired me anything? The first time even i dropped semester, and stayed 3 months back in nepal. Got OPT during assocaite also and worked for 1 year without going college in US. Got Bachelors this year and Got OPT also again and recently working too. Thinking of extending MY OPT for 17 months more. Applied for H1-B too(hoopefully i might get luckY) SO whether u work on not , ur not illegal, U r just breaking US law and this is very common. Make sure U file ur tax at the end of the year if u work on cheque, otherwise might IRS on door one day. I heard this filling of tax is helpful for u when u file ur greencard and many of us know it helps in credit history too. So RELAX!!!! don do any harm to US, don't break any Tough law and don't leave in any of illegal activity. FInally Most important, STAY in STATUS STATUS< STATUS>
