Hi Sajha Tax Experts,

I was wondering if it is ok for us nepalis to take standard deduction in our tax return. Are we legally allowed to do that? If yes how does that affect if you are in H1/F1 visa.

Not Tax expert but no affect if you go for standard or itemized deduction.You should ..you must at least take standard deduction.if you are using tax software i guess it does standard deduction automatically.If you have more to declare go for itemized and save some more money.

HI IMI......Is it possible to get more tax refund then the ammout that I have in my W2 form?
My tax was done from one of the office and calculated that I am getting 33 dollors more then I paid.My from was send online.
I appreciate your answer too.

i didn't understand what did you mean that tax refund is in w2?
well tax deducted is in w2, doesn't mean you are getting all back.sometime most people have to pay on top of what has already been deducted.

It depends also, ok here if you are low income and your tax has been deducted , the depending upon which catergory you fall under your tax will be refunded.And yes it is possible as they might have used wrong calculation to deduct your tax first of all.

if you did it from professional , they may be right.i am not tax consultant i am just sharing my knowledge what i know.

Thanks for your not so expert opinion IMI :).

You can actually get a lot back if you can just use Standardized deduction in place of itemized deduction. But as far as I know Nepalis are not allowed to use Standard deduction. We have to use itemized deduction. Indians have some special treaty with US which makes it legal for them to use the standard deduction. So, I was wondering if there is a some provision which makes us eligible to use standard deduction as well.

Does anybody have a clue what I am talkign about?

Who says that nepalese can't use standard deduction?i didn't get it where you heard that from.You save more from itemized deduction.Starndard deduction is $5000 per person.
what is you can show $8000 in itemized you save more right?:)
see you save more by itemizing but it is helpful if you can show and have somewhat reasonable proof of your expenses.
well don't worry ..you can do standard deduction.

and i have no clue on what you are talking about :P

I think they did my standardized dectution rather then intemized.Therefore I get more back.I am F1 visa holder and this is my second year school.
I just went there on the office with W2 form and 1098 T form.And they just do it and sent online.I have a copy of form too.They fill 1040 tax form (I think that is for us resident) insted 1040NR EZ They did not ask me about my country.
I am wondering whether I get money back or not?
And aslo wondering about its effect.
Need some advice somebody have for me.

ok lol ok ..i know these bunch of students who do your tax for free in school ..lol

ya they do that sort of thing. don't worry.If they have filled it and you know they did .then you should be fine.Even though they did 1040 you don't have to worry too much.You will get your money back if indeed they filed it.
reason: your tution fee is very high that is deductable from your income.
your income is so less as you work in school 20 hrs a week .
so don't be surprise that you getting money back..good for you:)

Oh thanks ImI -Tax person( As AznshawtY called you)I believe you have much more Ideas about taxes and those stuffs then other sajhalis.
Yaahhhhhhhhh It would be very very good for me if i get all of that money back.

In most cases unless you have invested money in stock or have a mortgage payment, standard deduction would be way more than itemized deductions. So, everybody would want to use standard deduction. I have looked up in the internet and so far haven't found anything saying non-resident alien can use 1040 form. ( 1040 has an option to use standard deduction where as 1040NR only includes itemized deduction ). Interestingly, I haven't seen anything that says non-resident alien MUST use 1040NR in most of the websites. Except at:

This website looks legitimate. So, I think we are not eligible to use standard deduction. Am I missing something? Does anybody know anything better?

Hello Ya'll,

Has any of you deducted a moving expense before? Since I moved last year because of a new job I know I'm eligible for it. However question becomes did I have to notify IRS about my new address when I moved.Well I haven't not yet notify IRS about my change of address . I think I read somewhere in the bulletine that one does.
The deduction is not much I thought since I am eligible go for it. But I don't want any hassale either if that's going to be a problem

Any inputs are appreciated!

I have an H-1B Visa and my husband has an F-1 Visa. We both lived in the United States all of last year and had income. What kind of form should we file? Do we file separate returns or a joint return?


Assuming both of you had these visas for all of last year, you are a resident alien. Your husband is a nonresident alien if he has not been in the United States as a student for more than 5 years. You and your husband can file a joint tax return on Form 1040, 1040A, or 1040EZ if he makes the choice to be treated as a resident for the entire year. See Nonresident Spouse Treated as a Resident in chapter 1. If your husband does not make this choice, you must file a separate return on Form 1040 or Form 1040A. Your husband must file Form 1040NR or 1040NR-EZ.

This answer kind of hints that I can qualify as resident if I have a H1b visa and have spent the whole year in US but does not clearly states what are the criterion for a nonresident alien to quality as resident alien for tax purposes. Anybody has any idea?
