Hi Sajhaities-I am seeking advice of H1b transfer in following scenario,your help is highly appreciated. I have been working for a company A for a year and I have latest paystubs of July 1.Do you guys have any experience of transferring your H1b with a gap of a month? Pls advice. Thanks in advance

They don't ask you anything........ I have seen this happening many times with many friends....... U are SAFE.

I have seen a couple of people who transferred H1B without any paystubs. I think it's doable. The reason they ask you paystubs is that you have been continuoulsy getting paid by your employer till that date. If your paystub says July 1 ( it's still July, you are not showing MAY or JUNE1), there won't be any problem at all.

h1btransfer, my suggestion is to file for H1B transfer ASAP if you haven't done already. You would be fine as long as the Paystub is not older than 60 days. Good Luck

Thanks AX-but for the worst case scenario,if USCIS ask for RFE ,What should be the best evidences to provide: one of the reason may be I were in leave: not sure what documents should I have as an evidence..?

H1btransfer, It is not clear here which paystub is missing. Is it Aug,June, May or older. How often do you get paid (Monthly, Bi-weekly)? I am assuming you will be missing paystub of Aug and if that is the case you should be fine. Just expedite your transfer quick....Even if june or May is missing, just send them last 3 pay stub. I know couple of my friends who were missing paystubs but they did not have any issue.

Aug25,1997 -Thanks for your input.Paystubs are biweekly and July 15 already missing and next one of Aug 1 will be missed too.I am worried about a month or little more gap and little worried about the consequences if my H1b transferred is denied. What if my h1b tranferred denied?Does it jeopardise h1b with my existing company or not? Thanks

h1btransfer, if your employer haven't notified USCIS then you won't have to worry. If you get RFE, you can ask your employer (hope you still have good terms) to write a letter stating you were on sick leave or unpaid vacation Why aren't you getting paystub?

Thanks AX for your response--I work with consulting company now and and I am in unpaid leave now.They will not report to USCIS.I am ok with present arrangement of status but worried for transfer process.I do not want to lose an opportunity to join better organization but at the same time getting worried about status issue. Thanks

I don't see any problem....It's common in H1B Community. In worse scenario, ask your employer to provide you paystubs but you may end up paying taxes :=) Find the new employer and transfer the H1B asap. All the Best

Shouldn't be a problem. I transferred my H1B last year without any problem. When my wife transferred her H1 one and half year back she was in a similar situation like yours. If you have paystubs that are month old you should be ok. I'd suggest you better hurry so that the gap does not get widened. One month gap shouldn't be of any problem.
